Terms of Service

These Terms of Service (“Terms”) govern your use of Phogit (“the App”), developed and published by Caffeinated Math, an umbrella of HJJB, LLC (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. About the app

Phogit provides a native git client for iOS devices. The App allows you to:

  • Clone, create, and manage git repositories on your device
  • Stage, commit, branch, merge, fetch, pull, and push
  • Browse repository files and edit source code
  • Visualize commit history with an interactive graph
  • Authenticate with remote git servers over HTTPS using personal access tokens or GitHub sign-in, or over SSH using keys created on your device

2. Eligibility

The App is suitable for all ages. If you are under the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. The App does not collect any user data: all operations and storage happen entirely on your device.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal or professional purposes, subject to these Terms and the Apple EULA.

You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Redistribute, sell, or sublicense the App
  • Use the App for any unlawful purpose
  • Remove or alter any proprietary notices

4. Your content

You retain ownership of all source code, repositories, files, and data you create or manage using the App. We do not claim any rights to your content.

Your content is stored locally on your device and is not transmitted to our servers. Remote git operations connect directly between your device and the remote server.

5. Third-party components

The App incorporates open-source components, including libgit2, tree-sitter, and SwiftTreeSitter, which are subject to their respective licenses. See the Credits page for acknowledgements.

When performing remote git operations, your device connects directly to external git servers. These servers are operated independently, and we are not responsible for the content, availability, or security of third-party services.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle information. In short, all git operations happen on your device and we do not collect your code, credentials, or repository data.

7. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will meet your requirements
  • The App will be uninterrupted or error-free
  • All git operations will complete successfully
  • All file formats or repository configurations will be supported

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF CODE, OR CORRUPTION OF REPOSITORIES.

Our total liability shall not exceed the amount you paid for the App.

9. Indemnification

You agree to indemnify and hold harmless HJJB, LLC and its officers, directors, and employees from any claims arising from your use of the App or violation of these Terms.

10. Changes to terms

We may update these Terms from time to time. Material changes will be communicated through App Store update notes. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to revoke your license to use the App, remove the App from the App Store, or discontinue the App at any time for conduct that violates these Terms.

12. Apple App Store

You acknowledge that these Terms are between you and HJJB, LLC, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you. Your use of the App is also subject to the Apple Media Services Terms and Conditions.

13. Governing law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles.

14. General provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect. These Terms constitute the entire agreement between you and us regarding the App, superseding any prior agreements.
